Your Rights Within a
Private Membership Association.
Evōke is a Private Membership Association. A recognised structure rooted in the constitutional right of free association. This framework creates a protected space where members may gather, practice, and heal outside the reach of public regulatory authority, in full accordance with natural law and religious liberty.
A Private Membership Association is a body of people who have voluntarily joined together under a private agreement, exercising their constitutionally protected right to freely associate. This right is enshrined in the First and Fourteenth Amendments of the U.S. Constitution and has been affirmed repeatedly by the Supreme Court.
Within a PMA, members enter a private, consensual relationship with one another and with the association itself. This relationship exists outside the public domain, meaning the activities, communications, and practices of the association are not subject to the same regulatory oversight that governs public commerce and public institutions.
Subject to Regulatory Oversight
Commercial transactions, public institutions, and public-facing organisations operate in the public domain and are subject to state and federal regulatory authority. This is the domain most businesses operate in.
Protected by Right of Association
Private associations operating under a voluntary membership agreement exist outside the public domain. Courts have consistently held that government authority does not extend automatically into the internal affairs of a lawfully established private association.
PMA + Church Ministry
Evōke operates as a PMA as an integrated auxiliary of Be Well Church Ministry. This dual structure provides overlapping legal and constitutional protections, the PMA for association rights, the ministry for religious liberty.
Participant, Not Customer
As a member, you are not a customer in a commercial transaction. You are a voluntary participant in a private faith community, with all the constitutional protections that entails. Membership is an act of informed, conscious agreement.

Freedom of Association
First Amendment · U.S. ConstitutionThe First Amendment guarantees the right of individuals to associate privately for any lawful purpose, spiritual, social, or otherwise. Courts have consistently held that private associations may conduct their affairs without government interference when members have voluntarily joined under a private agreement. Evōke's PMA structure rests directly on this right.
Religious Liberty
Free Exercise Clause · IRC 508(c)(1)(A) · Gonzales v. O Centro (2006)As an integrated auxiliary of Be Well Church Ministry, Evōke operates under the protections afforded to religious organisations under the Free Exercise Clause. Our spiritual practices, including the sacramental use of plant medicines in guided ceremonial contexts, are expressions of sincere religious belief. Gonzales v. O Centro (2006) established that the government bears a compelling burden to override sincere religious entheogenic practice.
Privacy of the Private Domain
Private Association Doctrine · First & Fourteenth AmendmentsAll interactions, communications, gatherings, and relationships within Evōke exist in the private domain. External regulatory bodies, state or federal, do not have automatic jurisdiction over the internal affairs of a lawfully established private association. Member records and communications are held in confidence and are not subject to public disclosure.

Inherent Sovereignty · Membership CovenantEvōke is governed by natural law principles, the conviction that individuals possess inherent sovereignty over their own bodies, minds, and spiritual paths. Members participate by informed, conscious choice, taking full responsibility for their own spiritual, physical, and emotional wellbeing. Conflicts are resolved through private mediation, not public courts.
Voluntary & Consensual Membership
PMA Voluntary StructureNo one is compelled to join Evōke. Membership is an act of conscious, informed agreement. Either party may end the relationship at any time with appropriate notice, while confidentiality and private status are maintained. This voluntary structure is what gives the PMA its legal and spiritual integrity. You are not a customer. You are a participant in a living faith community.
How the PMA Structure Protects Your Practice
The Private Membership Association structure is not administrative formality. It is the legal and spiritual container that makes Evōke's work possible. Because our relationship is private and consensual, members may participate in practices that fall outside the reach of public commercial regulation, including sacramental plant medicine ceremonies conducted within a sincere religious context.
This structure has a long legal history. Courts have upheld the rights of private associations to conduct their affairs free from state interference when membership is voluntary, the activities are lawful within the private domain, and a genuine associational purpose exists. Evōke meets all of these standards.
